About Renttro

Renttro platform (“Renttro Platform”) is an online marketplace that facilitates:

1. Users of Renttro mobile application (“Renttro App”) to list items for rent (“Rental Items”). These users of Renttro App are, hereinafter, referred to as “Renttro Partners” or “Owners”
2. Renttro Partners to communicate with and engage in rental transactions with other users (“Renttro Members”). These users can also be referred as “Renters”
3. Renttro Members to compensate Renttro Partners for availing the Listed Items on rental basis through Renttro Platform.
4. Renttro Members to compensate Renttro Partners for availing the Listed Items on rental basis through Renttro Platform.

Additional Communication Features

Users hereby agree to adhere to these Terms of Use, Rules of Permissible Usage, as set forth below.

Account Registration

To access Renttro services, users can create an account using email address and a secure password.

Only individuals aged 18 and above, capable of forming legally binding contracts, may register.

Users of Renttro Platform are themselves liable for safeguarding their login credentials. If a user suspects unauthorized access or suspicious activity emanating from his/her account, he/she shall promptly notify Renttro at info@renttro.com.

Users’ Agreement with Terms of Use

These Terms of Use, inclusive of the documents referenced herein, establish the terms of user's relationship with Renttro Platform. Users must understand and agree with these Terms of Use before using the services made available on Renttro Platform.

Depending on a user’s role as a Renttro Partners or Renttro Members, specific terms shall apply.

By accessing Renttro Platform and using services made available there, users agree to and accept these Terms of Use. Otherwise, users are advised to refrain from using products/services made available through Renttro Platform.

Safety Measures for Rental Items

Renttro merely provides a platform for Rental Items without actively monitoring their quality, safety and standards.

Renttro Partners shall ensure that their Rental Items match descriptions, are functional and safe to use. Renttro Platform is not liable for matching description, quality, functionality or safety of any Rental Item.

Renttro Partners shall be solely obligated and liable for complying with laws governing the items they offer for rent, addressing consumer rights and compensating for damages caused by their Rental Items.

Renttro Members shall be solely liable for Rental Items they obtain on rent, covering losses, damages and any harm caused to Renttro Partners or any third party by Renttro Members’ use of Rental Items.

Return of Rental Items

If a Renttro Members wants a return due to a change of mind or for no reason, he/she shall be liable for additional fees/charges, if applicable as per Renttro Partner’s policy.

A Renttro Members may return any Rental Item he/she is not satisfied with, except for those Rental Items that are specified under Renttro Partner’s no-return policy.

Cancellations Policy

No cancellation of order shall be permitted or entertained after the order has beenrecievedreceived by the Renttro Member.

No cancellation shall be permitted within forty-eight (48) hours of the expecteddelivery/pick-up of the Rental Item. Cancellation policies are defined and managed bythe Renttro Partners.

Usage of Renttro Platform

Sharing or transferring usage rights of Renttro Platform is strictly prohibited and shall constitute a violation of these Terms of Use.

Users of Renttro Platform herby expressly agree not to:

1. Copy or modify Renttro App,
2. Distribute or resell any part of Renttro Platform,
3. Make unauthorized changes to Renttro App or Renttro Platform, and
4. Access the source and other development code(s) not intended for general use.

All intellectual property rights in Renttro App and Renttro Platform shall remain with Renttro and/or its licensors; and

Users hereby acknowledge and agree that no proprietary rights to Renttro App or Renttro Platform are granted or accrue to any user beyond the scope of these Terms of Use.

Financial Terms

Collection of Fee

Once a Renttro Members commits to rent a Rental Item, Renttro will charge such Renttro Members the full rental fee on behalf of Renttro Partners.

Renttro Partners are, inter alia, liable for:

1. Legal capacity and right to list/offer Rental Items for rental purposes,
2. Ensuring that Rental Items precisely match the descriptions provided in the listing and are safe for usage,
3. Fulfilling all commitments made to Renttro Members in respect of Rental Items, and
4. Fully abiding by all relevant controlling laws, including UAE laws.

Any misrepresentation by a Lister or violation of these Terms of Use may lead to penalties and/or account suspension of Renttro Partners and Members.

Terms for Renttro Partners

This Section applies to all Renttro Partners who offer Rental Items on Renttro Platform.

Renttro Partners shall not offer for rent weapons, illicit materials, animals or anything deemed illicit, illegal according to the applicable laws, including, but not limited to, UAE laws.

Terms for Renttro Members

This Section applies to all Renttro Members who procure Rental Items from Renttro Platform.

Renttro Members, by renting the Rental Items, are only entitled to a limited usage right of such Rental Items during the rental period.

Renttro Members shall:

1. Ensure that they are legally eligible/competent and permitted to use the Rental Items,
2. Adhere to and abide by all relevant controlling laws governing use of the Rental Items, and
3. Return Rental Items in the same condition in which they received them, usual wear excepted.

Rules of Permissible Usage of Renttro Platform

The rules set forth in this Section shall apply to users’ activities on Renttro Platform. These rules may be referred to as “Rules of Permissible Usage”. Failure to comply with these Rules of Permissible Usage constitutes material breach hereof and may result in Renttro taking all or any of the following actions (with or without notice): (i) immediate, temporary suspension of violating user’s rights to use Renttro Platform or any aspects/features thereof; (ii) immediate, temporary or permanent removal of content submitted by violating user; (iii) issuing warning to violating user; and (iv) commencement of legal action against violating user, including proceedings for recovery of all costs resulting from the violation.

While using Renttro Platform, a user, Lister or Renter shall not:

1. Provide inaccurate, misleading or false information about himself/herself, his/her Rental Item(s) or any aspect related to the transactional process or impersonate another person,
2. Use Renttro Platform for any purpose other than for personal, non-commercial renting or listing Rental Items,
3. Upload content or listing items that infringe/violate the intellectual property rights, privacy rights or any other legally protected rights of third parties,
4. List or request items that are illegal, stolen or that promote illegal activities,
5. Engage in abusive, threatening, discriminatory, uncivil or harassing behavior towards other users or Renttro staff,
6. Attempt to communicate and consummate a rental transaction off the Renttro Platform to avoid paying Renttro’s fees or try to manipulate Renttro’s fee structure in any way causing detriment to Renttro,
7. Send unsolicited promotional messages, spam or any other form of solicitation,
8. Attempt to breach Renttro Platform’s security, spread malware or disrupt/sabotage Renttro’s services in any way or attempt to use Renttro Platform if his/her access has been suspended,
9. Engage in any activity that violates the controlling local, national or international laws or regulations, and
10. Create fake reviews, compel others for positive reviews or engage in any activity that undermines the integrity of Renttro’s review system.

Dispute Resolution

Dispute Resolution with Renttro

In case of a dispute between a user and Renttro relating to the use of Renttro Platform, user shall reach out to Renttro at info@renttro.com for amicable good faith resolution of the dispute. In the unlikely event that such dispute remains unresolved, Renttro will discuss and agree with user on the most effective way of resolving such dispute.

Dispute Between Users

In case of any dispute between users, such users shall first aim for an amicable resolution thereof via bilateral negotiations. If unresolved, users may seek Renttro’s intervention to effect resolution of such disputes. Notwithstanding the foregoing, Renttro shall not be obligated to act in any specific manner while attempting to resolve the disputes between users.

User-Generated Content

Users affirm that any media, text, details or information they upload onto RenttroPlatform, including reviews they post about other users or Rental Items (“UsersContent”) shall comply with the Rules of Permissible Usage.

Renttro does not assert ownership over Users Content. Ownership remains with usersand any third-party whose content they incorporate. Users are solely liable for ensuringthat they have neccessarynecessary authority to grant Renttro the above license for anythird-party content they incorporate in Users Content.

Users acknowledge and agree that Renttro’s utilization of Users Content does notcompromise users’ privacy rights. For information on how Renttro manages users’personal information, please refer to Renttro’s Privacy Policy.

Renttro reserves the right to monitor/moderate Users Content and to decline or removeany content that breaches the Rules of Permissible Usage.

Reporting Violations

If a user believes that any content on Renttro Platform infringes upon his/her rights, he/she shall send Renttro a notice at [Insert Email Address] with all pertinent details, including, but not limited to: (i) user’s name and contact details; (ii) specific link(s) or identification of the content or listing that user believes infringes upon his/her rights; (iii) concise explanation of how the content or listing infringes upon his/her rights; (iv) solemn declaration that the information provided in the notice is accurate and that user is authorized to act on behalf of the owner of the infringed right; and (v) physically or electronically signing the notice.

Upon receiving a proper notice, Renttro will take appropriate action(s), which may include removing the content or listing in question or suspending account of the user who posted it. If Renttro takes such action, Renttro may notify the affected user(s) and provide them with an opportunity to respond and explain.

Interpretation; Governing Law & Jurisdiction

Any dispute arising out of or in connection with these Terms of Use or the use of Renttro Platform between users, Renttro Partners, Renttro Members and Renttro shall be governed by and construed in accordance with laws of the UAE. Users, Renttro Partners and Renttro Members irrevocably agree that the courts of UAE shall have exclusive jurisdiction to finally settle any dispute or claim arising hereunder. Further, users also agree that any cause of action must commence within a reasonable time and in any event within six (06) months after the cause of action accrues.

Intellectual Property Rights

Renttro Content

All content provided by Renttro, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations and software, is the property of Renttro or its content suppliers and is legally protected by intellectual property protection laws.

Trademarks

Renttro and its logo(s) are trademarks or registered trademarks of Renttro. Users shall not use these marks for any purpose without the prior written permission of Renttro.

All other trademarks not owned by Renttro that appear on Renttro Platform are the property of their respective owners, who may or may not be affiliated with, connected to or sponsored by Renttro.

Prohibited Activities

Users are prohibited from engaging in any activity that infringes on the intellectual property rights of Renttro or any third party.

Users shall not upload, post, or otherwise make available any content that violates copyright, trademark or other intellectual property rights, whether or not legally protected.

Consequences of Infringement

Renttro reserves the right to take appropriate legal action against users who engage in intellectual property infringement, including but not limited to removing the infringing content and terminating the violating users’ accounts.

Dispute Resolution

In cases of intellectual property disputes between users, Renttro may act as a mediator to facilitate resolution. Users agree to fully cooperate with Renttro during any such informal dispute resolution process.

Contact, Feedback, and Complaints

Renttro values hearing from its users and is always interested in learning about ways it can improve the Renttro Platform.

Modification of Terms of Use

Renttro may modify these Terms of Use at any time without prior notification to users. Users are advised to keep themselves acquainted with most recent version of these Terms of Use. If the modified Terms of Use are not acceptable for any of the users, he/she should immediately cease using Renttro Platform. However, if a user continues to use Renttro Platform, he/she shall be deemed to have accepted and agreed to the modified Terms of Use.

Apple App Store Provisions

This Section applies where the Renttro App has been downloaded from the Apple App Store. Users acknowledge and agree that these Terms of Use are between users and Renttro, not Apple, Inc. (“Apple”) and that Apple has no responsibility for Renttro App or its content. The users must also follow App Store Terms of Service while using Renttro App.

Users acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Renttro App. To the maximum extent permitted by applicable law, Apple will have no warranty obligation whatsoever with respect to Renttro App.

Users acknowledge that Apple is not responsible for addressing any claims of users or any third party relating to Renttro App or users’ possession and/or use of Renttro App. This includes: (i) product liability claims; (ii) any claim that Renttro App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar laws.

In the event of any third-party claim that the Renttro App or users’ possession and/or use of Renttro App infringes on that third party’s intellectual property rights, Renttro, not Apple, will investigate, defend, settle and discharge any such intellectual property infringement claim to the extent required by these Terms of Use.

Google Play Store Provisions

This Section applies where Renttro App has been downloaded from the Google Play Store. Users acknowledge and agree that these Terms of Use are between users and Renttro, not Google Inc. (“Google”) and that Google has no responsibility for Renttro App or its content. Users must follow the Google Play Terms of Service while using Renttro App.

Users acknowledge that Google has no obligation whatsoever to furnish any maintenance and support services with respect to Renttro App.

Renttro, not Google, is responsible for addressing any claims by users or any third party relating to Renttro App or users’ possession and/or use of Renttro App.

In the event of any third-party claim that Renttro App or users’ possession and use of Renttro App infringes on that third party’s intellectual property rights, Renttro, not Google, will investigate, defend, settle and discharge any such intellectual property infringement claim.

LIMITATION OF LIABILITY

WHILE RENTTRO WILL DO ITS BEST TO ENSURE THAT RENTTRO APP ITSELF IS OF A REASONABLE STANDARD AND QUALITY AND MATCHES THE STATED DESCRIPTIONS, RENTTRO APP AND ANY OTHER PORTION OF RENTTRO PLATFORM MAY CONTAIN SOME CONTENT OWNED OR DEVELOPED BY THIRD PARTIES.

IN ADDITION, DUE TO NATURE OF THE INTERNET AND TECHNOLOGY, RENTTRO PLATFORM IS PROVIDED ON “AS IS” BASIS. THIS MEANS THAT USE OF RENTTRO PLATFORM MAY NOT BE UNINTERRUPTED, WITHOUT DELAYS, ERROR-FREE OR MEET USERS’ EXPECTATIONS AND RENTTRO DOES NOT MAKE ANY COMMITMENT RELATING TO THE PERFORMANCE OR AVAILABILITY OF RENTTRO PLATFORM. TO THE FULLEST EXTENT PERMITTED BY LAW, RENTTRO EXCLUDES/DISCLAIMS ANY COMMITMENTS THAT MAY BE IMPLIED BY LAW OR EQUITY.

IN THE EVENT OF A CLAIM ARISING OUT OF THE PROVISION OF RENTTRO PLATFORM, RENTTRO’S LIABILITY TO A USER/LISTER/RENTER SHALL NEVER BE MORE THAN THE AMOUNT SUCH USER/LISTER/RENTER HAS PAID TO RENTTRO IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM ARISING, AND, IN THE EVENT THAT SUCH USER/LISTER/RENTER HAS NOT PAID RENTTRO ANY FEE/MONEY, RENTTRO SHALL HAVE NO LIABILITY WHATSOEVER. FURTHER, RENTTRO SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.

Termination of Access/User Account

If a user disagrees with these Terms of Use, or any updates hereof, he/she must cease using Renttro Platform immediately.

Removing the Renttro App does not imply account closure. To close account, user must contact Renttro through info@renttro.com.

When you delete your Renttro account, all associated single sign-on data, including those linked to Apple, Google, or Facebook, will also be permanently removed.

Renttro may modify or remove parts of Renttro Platform. In case of materially significant modifications, Renttro will notify users.

If access is terminated, Renttro might delete user’s (whose access is terminated) content and all associated data. It is advisable for all users to maintain backups of any content or data they value.

Termination of a user’s access shall not absolve him/her from any outstanding financial obligations such user owes to Renttro, Renttro Partners, Renttro Members etc.

Data Deletion Request

To request the deletion of your data, you can:

1. Open our mobile application.
2. Navigate to the "Settings" section.
3. Find the "Delete Account" option and follow the provided instructions.
4. You can also send an email to our support team at info@renttro.com with the subjectline "Data Deletion Request." In your email, please provide the following information:
   • Your full name.
   • A clear statement that you are requesting the deletion of your data.
   • Any additional information that may help us locate your data.

Miscellaneous

Severability:The invalidity or unenforceability of any provision of these Terms of Use shall not adversely affect the validity or enforceability of the remaining provisions.

Headings:The headings in these Terms of Use are solely used for convenience and shall not have any legal or contractual significance or affect interpretation hereof.

English Version to Prevail:If these Terms of Use are translated into any other language and there is a discrepancy between the English text and text of the other language, the English version will prevail.

No Waiver:No delay or forbearance by Renttro in enforcing any provisions of these Terms of Use or any of Renttro’s rights hereunder shall be construed as a waiver of such provisions or Renttro’s right thereafter to enforce the same.

No Third Party Beneficiaries:These Terms of Use shall inure to the benefit of and be binding upon Renttro, users, Renttro Partners, Renttro Members and their successors.

Force Majeure:Renttro shall not be liable for any loss suffered by users, Renttro Partners, Renttro Members or be deemed to be in default for any delays or failures in performance hereunder resulting from acts or causes beyond its reasonable control, including but not limited to communication disruptions, acts of God, acts or regulations of any governmental or controlling authority etc.

Assignment:Renttro reserves the right to assign any or all its rights and obligations under these Terms of Use. The users, Renttro Partners and Renttro Members shall not assign or otherwise transfer their rights or obligations hereunder without Renttro’s prior written consent.
